1. Agreement to these terms
By accessing or using Noia Homeyear, its websites, mobile applications, communications, exports, and related services (collectively, the “Service”), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service.
The Service is offered to individual adult account holders for personal and family use. It is not offered to schools, co-ops, or other organizations unless we enter into a separate written agreement.
2. Eligibility and account responsibility
The Service is intended only for people who are 18 years of age or older and able to form a binding contract. Learners do not create accounts or use the Service independently. You must provide accurate account information, keep credentials confidential, and promptly notify us through Contact us if you suspect unauthorized access.
You are responsible for activity performed through your account and authorized devices, except to the extent caused by our breach of applicable law.
You may create a learner profile only when you have lawful authority and all required permissions to provide and manage that learner’s information.
You must review learner information and generated content and maintain appropriate account and device controls.
3. What the Service provides
Noia Homeyear provides tools for organizing homeschool and family learning, including learner profiles, topic and skill views, calendars, attendance, activity logs, photos and notes, reading records and recommendations, progress summaries, transcripts, grades, reporting drafts, exports, and AI-assisted planning and conversation.
Planning tool—not an accredited school
Unless we expressly agree otherwise in writing, Noia Homeyear is not a school, teacher, attorney, accountant, filing service, government agency, accreditor, or official custodian of your legally required records.
4. Educational and legal responsibility
Homeschool laws, attendance rules, subjects, instructional-hour requirements, grading practices, portfolio rules, filing deadlines, and reporting obligations vary by location and may change. You are solely responsible for determining and satisfying the requirements that apply to your family.
Review every calendar entry, attendance status, grade, transcript, progress value, report, and export before relying on or submitting it.
Maintain independent copies of records that are important or legally required.
Confirm official requirements with the appropriate authority or a qualified professional.
The Service does not guarantee academic outcomes, eligibility, credit, promotion, admission, accreditation, reimbursement, or acceptance of any generated record.
5. AI-assisted features
The Service may use artificial intelligence and automated systems to respond in the assistant, summarize a week, infer a draft event from materials, recommend books or topics, organize evidence, and help prepare reports. Inputs and relevant account context may be sent to service providers that help operate these features.
AI processing is an integral part of Noia Homeyear and is not an optional mode. If you do not want account or learner information processed for these AI-assisted features, do not use the Service.
AI output may be inaccurate, incomplete, outdated, biased, unsuitable, or similar to content generated for others.
AI output is a draft for adult review and is not professional, legal, educational, medical, safety, or other expert advice.
Do not use AI output as the sole basis for a consequential decision about a learner.
Do not submit secrets or information you are not authorized to disclose. Use the minimum learner information needed for the task.
You are responsible for reviewing, editing, and deciding whether to use or share any output.
6. Your content and learner records
“Your Content” includes information, text, messages, prompts, notes, learner profiles, goals, grades, attendance, events, reading records, photos, images, audio-derived transcripts, uploaded materials, and other content you provide or create through the Service. As between you and us, you retain your rights in Your Content.
You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, format, display, process, and create technical or service-generated derivatives of Your Content only as reasonably necessary to operate, secure, improve, support, and provide the Service, comply with law, and enforce these terms. This license ends when the content is deleted from active systems, subject to reasonable backup, security, legal, and dispute-retention periods.
You represent that you have all rights, permissions, consents, and authority needed for Your Content and our permitted processing of it.
You must not upload unlawful, infringing, deceptive, exploitative, abusive, or privacy-invasive content.
You must not upload learner information unless you have lawful authority and all required permissions.
You are responsible for checking exports and preserving independent backups.
7. Photos, camera, microphone, and speech recognition
Optional features may request access to your camera, selected photos, microphone, or device speech-recognition service. You control these permissions through your device. Voice features may convert speech to text using services supplied by your device platform or configured speech provider.
Obtain permission from every person whose image, voice, work, or personal information you capture. Do not use recording features where recording is prohibited or where legally required consent has not been obtained.
8. Reading recommendations, affiliate links, and third parties
Reading suggestions, learning references, partner cards, and external links are informational and may be generated or ranked automatically. Some book or product links may be affiliate links, which means we may receive a commission at no additional cost to you.
A recommendation is not an endorsement, guarantee of suitability, availability, price, accuracy, safety, or learning outcome.
Review books, products, websites, and age suitability before using a recommendation with a learner or making a purchase.
Third-party services have their own terms, privacy practices, accessibility, and security. We are not responsible for them.
9. Acceptable use
You may use the Service only for lawful personal, family, and educational purposes. You may not:
violate law, another person’s rights, privacy, or safety;
harass, exploit, endanger, impersonate, or misrepresent affiliation with another person;
upload malware, scrape or harvest data, probe security, bypass access controls, or disrupt the Service;
reverse engineer, resell, sublicense, frame, mirror, or commercially exploit the Service except where law permits or we agree in writing;
use automated means at unreasonable volume or use Service output to train a competing model or service without written permission;
submit content or prompts intended to generate unlawful, dangerous, sexually exploitative, or abusive material; or
use the Service to make automated high-impact decisions about a learner or another person.
10. Our intellectual property
The Service, including its software, designs, branding, artwork, interfaces, compilations, and original content, is owned by us or our licensors and protected by intellectual-property laws. Subject to these terms, we grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for its intended purpose.
If you provide suggestions or feedback, you permit us to use them without restriction or compensation, provided we do not publicly identify you without permission.
11. Availability, changes, and beta features
The Service may contain placeholder, preview, beta, experimental, or third-party-dependent features. We may add, change, suspend, limit, or discontinue features, integrations, storage limits, or availability. We do not promise uninterrupted, error-free, or permanently available access.
Current versions may not include payments or subscriptions. If paid features are introduced, material pricing and renewal terms will be presented before purchase and any legally required cancellation rights will apply.
12. Suspension and termination
You may stop using the Service at any time. While signed in, you may delete your Noia Homeyear profile from Profile settings. This removes the information associated with that profile from Noia Homeyear. We may restrict or terminate access when reasonably necessary to address a material breach, unlawful activity, security or safety risk, nonpayment of an applicable fee, legal requirement, or discontinuation of the Service. Where appropriate, we will provide notice and a reasonable opportunity to correct a breach.
Provisions that need to continue after use of the Service ends, including ownership and permitted handling of content already processed, will continue only as reasonably necessary.
13. Disclaimers
Use at your own judgment
To the fullest extent permitted by law, the Service and all content, recommendations, outputs, reports, and exports are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, or results.
We do not warrant that data will never be lost, that generated content will be correct, that the Service will meet a particular legal or educational requirement, or that third-party services will remain available.
14. Our responsibility
We are responsible for providing the Service with reasonable care. We are not responsible for problems caused by inaccurate information you provide, decisions made without reviewing generated content, third-party services outside our control, or use of the Service in a way these terms do not allow.
Nothing in these terms removes rights or remedies that cannot be limited under applicable law.
15. Changes to these terms
We may update these terms to reflect changes in the Service, law, or our operations. We will post the revised terms and update the date above. If a change materially reduces your rights, we will provide additional notice when reasonably required. Continued use after the effective date means you accept the revised terms; if you do not agree, stop using the Service.
16. Contact and general terms
These terms and the Privacy Policy describe the agreement for the consumer Service. If one part cannot be enforced, the remaining parts continue to apply.
The Service is operated by ToysEngage LLC. Questions, legal notices, and concerns may be submitted through Contact us. Privacy and data requests are available to active account holders while signed in so we can verify identity and authority.
